Payment in monthly increments by any means other than bank checking card or credit card is only permitted on a case-by-case basis. Clients will be charged $147 per month for a 12 month term or $177 per month for a 6 month term monthly for Health Studio Services.

Refund Policy/Cancellation
Members are entitled to the penalty-free cancellation of this contract within 3 days, exclusive of holidays and weekends, of its making, upon the mailing or delivery of written notice to the health studio, and refund upon such notice of all moneys paid under the contract, except that the health studio may retain an amount computed by dividing the number of complete days in the contract term, or if appropriate, the number of occasions
the health studio are to be rendered into the total contract price and multiplying the result by the number of complete days thats have passed since the making of the contractor or, if appropriate, by the number of occasions the health studio services have been rendered A refund shall be issued within 30 days after receipt of the notice of cancellation.
A member's notice of his/her intent to cancel shall be given in writing to the health studio. And that such a notice of cancellation shall also terminate automatically the consumer's obligation to any entity to whom the health studio has subrogated or assigned the consumer's contract. And that if the health studio wishes to enforce such contract after receipt of the notice, it may request the department to determine the sufficiency
of the notice
That if the department determines that a refund is due to the buyer, the refund shall be an amount computed by dividing the contract price by the number of weeks in the contract term and multiplying the result by the number of weeks remaining in the contract term. The business location of a health studio shall not be deemed out of business when temporarily closed for repair and renovation of the premises:
The initial contract will not exceed 36 months and thereafter shall only be renewable annually. renewal contracts may not be executed and the fee therefore paid until 60 days or less before the preceding contract expires.
If the health studio requires a buyers to furnish identification upon entry of the facility and as a condition of using the services of the health studio, the health studio will provide the buyer with the means of such identification .
With respect only to health studios exempt from posting security, the following statement must be included verbatim, in all capital letters, bold font, and at least 10 point font:
SHOULD YOU (THE BUYER) CHOOSE TO PAY MORE THAN 1 MONTH OF THIS AGREEMENT IN ADVANCE, BE AWARE THAT YOU ARE PAYING FOR FUTURE SERVICES AND MAY RISKING LOSS OF YOUR MONEY IN THE EVENT THE HEALTH STUDIO AND/OR THIS BUSINESS LOCATION CEASES TO OPERATE . THE HEALTH STUDIO IS NOT REQUIRED BY FLORIDA LAW TO PROVIDE ANY SECURITY, AND THERE MAY NOT BE OTHER PROTECTIONS PROVIDED TO YOU SHOULD YOU PAY IN ADVANCE.
After the 3 day penalty free cancellation period:
The cancellation policy is contract remaining balance buy-out plus a $100 buy-out fee. The cancellation policy is a professional courtesy to others. That being said, there may be people waiting for slots in our Guaranteed Transformation Program. The reason being is that we need time to notify and setup those waiting for an empty slot. The client will retain the option to buy-out of their current 6, 12, -month billing agreement with a 3 day cancellation notice and paying an additional a buy-out fee of $100. Once the 3 day cancellation notice is received by Madeforthis Fitness, LLC along with the buy-out of your remaining contract balance and the additional $100 buy-out fee, your commitment will be cancelled on that date one month later
IF CLIENT CHOOSES TO PAY IN FULLANY PACKAGE UP FRONT, THERE IS ABSOLUTELY NO REFUND PERMITTED WHATSOEVER UNDER ANY CIRCUMSTANCES!
Injury or Death Clause:
Our contract provides for the cancelation of our contracts if the buyer happens to die or become physically unable to avail himself or herself of a substantial portion of those services which the buyer used from the commencement of the contract in an amount computed by dividing the contract price by the number of weeks in the contract term and multiplying the result by the number of weeks remaining in the contract term. Our contract may require a buyer or the buyer's estate seeking relief under this paragraph to provide proof of disability or death. A physical disability sufficient to warrant cancelation of the contract by the buyer is established if the buyer furnishes to the health studio a certification of such disability by a physician licensed under Chapter 458, 459, 460, or Chapter 461 provided the diagnosis or treatment is within the physicians scope of
practice. A refund shall be issued within thirty (30) days after receipt of the notice of cancellation made pursuant to this paragraph.
Our fitness center is exempt from posting security must include in all contracts for our fitness center services in the following disclosure statement.
SHOULD YOU (THE BUYER) CHOOSE TO PAY FOR MORE THAN 11 MONTHS OF THIS AGREEMENT IN ADVANCE, BE AWARE THAT YOU ARE PAYING FOR THE FUTURE SERVICES AND MAY BE RISKING LOSS OF YOUR MONEY IN THE EVENT OUR FITNESS CENTER AND/OR THIS BUSINESS LOCATION CEASES TO OPERATE . OUR FITNESS CENTER IS NOT REQUIRED BY FLORIDA LAW TO PROVIDE ANY SECURITY, AND THERE MAY NOT BE OTHER PROTECTIONS PROVIDED TO YOU SHOULD YOU CHOOSE TO PAY IN ADVANCE.
MOVE OF FACILITY CLAUSE:
Our contract provides for cancellation and refund of our contract if the contracting business location of the fitness center goes out of business, or moves its facilities more than (5) driving miles of the business location designated in the contract and fails to provide, within 30 days, a facility of equal quality located within 5 driving miles of the business location designated in the contract at no additional cost to the buyer.
In case MADEFORTHISFITNESS LLC should move to another location or close business, you can contact FLORIDA DEPARTMENT OF AGRICULTURE AND CONSUMER SERVICES for any information within (60) days should MADEFORTHISFITNESS LLC go out of business.
NON COMPETE/SOLICITING CLAUSE :
In consideration of being a member, you are prohibited to engage in the business of any form of solicitation that pertains to any form of offering a competitive conflict of interest pertaining to MadeForThisfitness,LLC whatsoever while in,around or any affiliation with our facility/company. This includes clients , potential clients current or potential, nutrition plans , meal prep, training, coaching of any kind, merchandise, online training , online nutrition plans etc. You are prohibited to suggest , give or instruct any workout on nutrition advice or suggest directly or indirectly witth MadeForThisfitness clients or potential clients in our facility , around our facility or anything affiliated with MadeForThisfitness LLC.
Both parties agree that confidentiality is a materiel part of this covenant. If any dispute arises between the parties regarding the breach, enforceability or construction of this covenant will result in a fine of $1,000.00 for breach of legal contract agreed & signed upon. Member will be held responsible for any lawyer , legal or any additional fees.
By reading, initializing, and signing below you agree to the following:
- I agree to purchase and pay for my agreed upon Madeforthis Fitness, LLC , Guaranteed Transformation Program training agreement as an automatic charge to my bank account via ACH, or other form of payment each month for the agreed period.
- I hereby certify that I am the holder or an authorized signer on the checking card account or credit card.
- I understand and agree that I will be notified if my checking account or credit payment fails to authorize for any reason, and that a $20 return/late fee will apply. Additionally, you must provide valid credit card information within 3 calendar days of the original rejection date.
- In the event that I cease, for any reason to participate in The Transformation Training Program, I understand and agree that I am still liable for the unpaid balance of the service fee payment of which shall be due and payable as set forth above. I agree that I will be responsible for all reasonable legal fees and other cost incurred by Madeforthis Fitness, LLC in collecting any amounts owed under this agreement, in addition to all other remedies available to Madeforthis Fitness, LLC.
